The North Carolina State Supreme Court has declined to review a Court of Appeals decision regarding membership and monthly overhead fees at The Cedars.

The decision was announced late last week, after the unanimous state Court of Appeals ruling in June.

Three appellate court judges had overturned a Wake County Special Superior Court ruling from January 2014 that the Cedars must stop collecting the fees.

The ruling said the fees were legal because they were clearly laid out in the contract signed upon purchase of a condo in The Cedars – which offers housing from independent living to skilled nursing care.

The members owns their condos and share common areas.

Bob Woodruff, CEO of The Cedars says in a statement, “We believe the financial structure of The Cedars is the best in the industry because residents are allowed to own their own homes. The N.C. Court of Appeals and Supreme Court got it right. The residents of The Cedars should be allowed to enjoy our community without outside interference.”

The Cedars is located in Chapel Hill’s Meadowmont community.
