UNC and the NCAA have filed motions of dismissal in federal court concerning a lawsuit brought by two former student athletes.

Former Carolina women’s basketball player Rashanda McCants and football player Devon Ramsay filed the class-action lawsuit in January, alleging that they were not provided an education that included academically sound classes with legitimate educational instruction.

The motion for dismissal from UNC alleges that the plaintiff’s claims are barred by the eleventh amendment, that the claims are time barred, and that the plaintiffs have failed to establish a material breach of contract and have not sufficiently pled damages.

This is one of several allegations that have been made at Carolina after revelations that “paper classes” were conducted at the university for nearly two decades ending in 2011.

McCants graduated from UNC in 2009 with a degree in Communications and Media Productions. Ramsay is a 2012 graduate of Carolina with a degree in Public Policy.
